Terms and Conditions of Membership

Use of ERLMS Management Programme

The “ERLMS Management Programme” (also known as “the Programme”) available for sale to individuals and organisations is an annual membership subscription service (“Service”) offered by ERLMS Limited (the “Company”).   The Programme is the sole property of the Company or its licensors and is protected by copyright and other intellectual property laws.  The contents of the Programme, the management tools and information provided through this Service as components of the membership entitlement and received by individuals or organisations who subscribe to the Programme (“Customers”) can be displayed, reformatted, and printed for the Customers’ personal use but they are not to be used in any way for commercial purposes.  Customer agrees not to reproduce, retransmit, distribute, disseminate, sell, publish, circulate or broadcast the contents, the management tools and information received through this service to anyone, including those outside the organisation, without the express prior written consent from the Company.  Customer must not post the Programme, the contents, the management tools and information received through this Service to newsgroups, mail lists or electronic bulletin boards, without the express prior written approval of the Company.  No other use of the Programme is permitted, including without limitation, co-branding, framing, or hyper-linking, without the express written permission of the Company.  Customer agrees not to use the “Programme” in any illegal manner.

Warranty and Liability Disclaimer

The Company and its associates, agents and licensors cannot and do not warrant the accuracy, completeness, correctness, non-infringement, merchantability or fitness for a particular purpose of the content available through the Service.  Neither the Company nor any of its associates, agents or licensors shall be liable to Customer or anyone else for any loss or injury, caused in whole or in part by its negligence or contingencies beyond its control in procuring, compiling, interpreting, reporting or delivering the contents of the Programme through the Service.  In no event will the Company, its associates, agents or licensors be liable to Customer or anyone else for a decision made or action taken by the Customer in reliance on such content or the Service.  The Company, its associates, agents and licensors shall not be liable to Customer or anyone else for any damages (including, without limitation, consequential, special, indirect, incidental or similar damages) even if advised of the possibility of such damages.

The Company may discontinue or modify the Service, or its availability to Customer, at any time.  The Company is not liable to pay any refund to the Customer.  This agreement is personal to the Customer.  If any provisions of this agreement are invalid or unenforceable under applicable law, the remaining valid provisions shall continue in full force and effect.

The Service includes facts, opinions and recommendations of individuals and others.  Company and its content licensors do not guarantee accuracy, completeness or timeliness of, or otherwise endorse or promote these opinions or recommendations.  Any information relied on by Customer, is relied on at Customer’s sole risk.

In no event shall ERLMS Limited, its associates, affiliates, agents, suppliers or licensors be liable to any person or organisation (“Customers”) for any direct, indirect, consequential or other damages (including, without limitation, any lost profits, loss of information or other data) that are related to the use of, or the inability to use, the contents of the Programme included in this Service.

Application and Usage of Membership Entitlement

The 10 free Organisational, Human Resource and Business Management tools provided as part of the member entitlement are for use only by the individual member or member organisation/office that subscribes to the programme.  The 10 free management tools received by the individual member or member organisation cannot be used or applied by any other offices of the individual member or member organisation that are not a subscriber to the ERLMS Management Programme.   However, this service or usage of the management tools can be extended to be used by the individual member or member organisation’s other offices at additional costs, with the actual cost charged based on the number of offices the service is to be extended to.

The 12 hour free consultation and advice’s member entitlement is for use only by the individual member or member organisation/office that subscribes to the ERLMS Management Programme.

The benefits and services provided as parts of the membership entitlement are for a single membership subscription period.  Members are encouraged to make full use of the benefits, services and free consultation time included in the programme during the 12 month membership subscription period.  Any outstanding benefits, services or consultation time not used during the 12 month membership period will not be reimbursed any membership fee paid and will not be carried over to subsequent membership subscription periods.

Fee and Fee Payment

The annual membership subscription fee for the Programme is in US Dollars and must be paid upfront through direct transfer of payment from the Customer’s bank account to the Company’s bank account.  

•     All sales are considered final once a payment is rendered.
•     There are no refunds.
•     There are no exchanges

Any other costs required to carry out the services included in the membership entitlement of the Programme will be invoiced to the Customer and must be paid within 14 days from the date of the invoicing through direct transfer of payment from the Customer’s bank account to the Company’s bank account.
